Terms of Service

These Terms and Conditions ("Terms") govern access to and use of the website dxfsplitter.com and the DXF Splitter software service (together, the "Service"), operated by JETCAM International s.a.r.l., a company registered in Monaco ("JETCAM," "we," "us," or "our"). By creating an account, purchasing a Day Pass, subscribing to Pro, or otherwise using the Service, you ("you," "User") agree to be bound by these Terms. If you do not agree, do not use the Service.
If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, and "you" refers to that entity.
1. Description of the Service
DXF Splitter is a software tool that analyses a DXF file representing a layout of multiple parts and attempts to automatically detect and separate the individual part elements contained within it, producing individual output files (and, where applicable, a part report) for download.
The Service is a productivity aid. It is not a substitute for the User's own review, quality control, or engineering judgement, and JETCAM makes no representation that the Service will correctly, completely, or accurately identify every part, layer, label, or geometric feature in any given file.
2. Eligibility and Accounts
2.1 You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
2.2 An account is required to process a file, including on the free tier. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
2.3 You must provide accurate registration and billing information and keep it up to date.
2.4 We may suspend or terminate an account that we reasonably believe is being used fraudulently, abusively, or in breach of these Terms.
3. Plans, Pricing, and Payment
3.1 The Service is offered under the following plans, as described on the pricing page at dxfsplitter.com: a limited free tier (single nest, up to 100 parts, output not downloadable beyond the limit), a one-time Day Pass, and a Pro subscription billed monthly or annually.
3.2 All prices are shown in EUR and are exclusive of any applicable taxes unless stated otherwise. Where required by law, applicable VAT or other sales tax will be added at checkout based on your billing location.
3.3 Pro subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
3.4 We may change our prices at any time. Price changes will not affect a billing period already paid for, and we will give existing subscribers reasonable notice before a price change takes effect on their next renewal.
3.5 Right of withdrawal / immediate performance. If you are a consumer in the European Union or another jurisdiction granting a statutory right to withdraw from a digital service purchase, you acknowledge that the Service is supplied and begins immediately upon payment (i.e., you gain immediate access to process a file), and you expressly consent to this immediate performance and acknowledge that you thereby lose your statutory right of withdrawal once performance has begun, to the extent permitted by applicable law.
3.6 Refunds. Outside of any non-waivable statutory right, refunds are granted at JETCAM's sole discretion on a case-by-case basis. Submitting a refund request does not guarantee a refund will be issued.
4. Acceptable Use
You agree not to:
- use the Service to process files you do not have the right to use;
- attempt to reverse engineer, decompile, or extract the underlying algorithms of the Service;
- resell, sublicense, or provide third-party access to the Service without our written consent;
- use automated means to create accounts or circumvent free-tier limits;
- interfere with or disrupt the integrity or performance of the Service or its infrastructure;
- use the Service in any way that violates applicable law.
We may suspend access for any account reasonably suspected of violating this section.
5. Your Files and Content
5.1 You retain all ownership rights in the DXF files you process and in the output files generated from them. JETCAM claims no ownership over your designs.
5.2 You are solely responsible for ensuring you have the necessary rights to upload and process any file through the Service.
5.3 Details of how your files are technically handled (including whether and how they are transmitted to or stored on our servers) are set out in our Privacy Policy, which forms part of these Terms.
6. No Warranty; User Responsibility to Verify Output
6.1 THE SERVICE, INCLUDING ALL OUTPUT FILES, PART REPORTS, AND SPLIT RESULTS, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT, EXCEPT WHERE SUCH EXCLUSION IS NOT PERMITTED BY APPLICABLE LAW.
6.2 JETCAM does not warrant that the Service will correctly detect every part boundary, layer assignment, bend line, marking, or text label in a source file, or that the split output is complete, dimensionally accurate, or suitable for any specific manufacturing or production process.
6.3 You are solely responsible for independently reviewing, verifying, and quality-checking any output produced by the Service before relying on it for cutting, machining, manufacturing, procurement, costing, or any other downstream use. JETCAM is not responsible for the consequences of using unverified output.
7. Limitation of Liability
7.1 To the maximum extent permitted by applicable law, JETCAM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, materials, production time, or goodwill, arising out of or in connection with your use of, or inability to use, the Service, however caused, even if JETCAM has been advised of the possibility of such damages.
7.2 To the maximum extent permitted by applicable law, JETCAM's total aggregate liability arising out of or relating to these Terms or the Service, for any cause whatsoever, shall not exceed the total amount you paid to JETCAM for the Service in the twelve (12) months preceding the event giving rise to the claim, or EUR 100 if no payment was made.
7.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud or wilful misconduct.
8. Indemnification
You agree to indemnify, defend, and hold harmless JETCAM, its officers, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your use or reliance on any output generated by the Service, including any manufacturing, production, or other downstream consequences of that use; (c) your violation of these Terms; or (d) your violation of any third-party right, including intellectual property rights in files you process.
9. Service Availability and Changes
9.1 We aim to keep the Service available but do not guarantee uninterrupted, error-free, or continuous access. The Service is provided on an "as available" basis with no service level agreement unless separately agreed in writing.
9.2 We may modify, suspend, or discontinue any part of the Service, including features, pricing tiers, or limits, at any time. We will make reasonable efforts to notify subscribed Pro users of material changes affecting their plan.
10. Intellectual Property
The Service, including its software, design, branding, and underlying technology, is owned by JETCAM or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right or license to JETCAM's intellectual property except the limited right to use the Service in accordance with these Terms.
11. Termination
11.1 You may stop using the Service and delete your account at any time.
11.2 We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent or abusive conduct, or if required by law.
11.3 Sections 5, 6, 7, 8, 10, and 13 of these Terms survive termination.
12. Privacy and Data Protection
Our collection and use of personal data in connection with the Service is described in our Privacy Policy at [LINK]. By using the Service, you consent to that processing.
13. Governing Law and Jurisdiction
13.1 These Terms are governed by the laws of the Principality of Monaco, without regard to its conflict-of-laws principles.
13.2 Subject to clause 13.3, any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Monaco.
13.3 If you are a consumer habitually resident in the European Union or another jurisdiction whose law grants you mandatory consumer protections that cannot be limited by contract, nothing in this clause 13 deprives you of the protection of those mandatory rules, or of your right to bring proceedings in the courts of your own country of residence where applicable law entitles you to do so.
14. Force Majeure
JETCAM shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, internet or infrastructure outages, war, or governmental action.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (e.g., by email or a notice on the Service). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
16. Miscellaneous
16.1 If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
16.2 Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
16.3 You may not assign or transfer your rights under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
16.4 These Terms, together with the Privacy Policy, constitute the entire agreement between you and JETCAM regarding the Service.
